How OSHA Calculates Penalties
OSHA's penalty structure is defined by the Federal Civil Penalties Inflation Adjustment Act. As of 2024, maximum penalties are:
- Serious violations: up to $16,131 per violation
- Other-than-Serious: up to $16,131 per violation
- Willful or Repeated: up to $161,323 per violation
- Failure to Abate: up to $16,131 per day beyond the abatement date
OSHA adjusts penalties based on four factors: the gravity of the violation, the employer's size, good faith efforts, and history of prior violations. Our calculator uses real enforcement data from 2,336,195 inspected facilities to show what employers actually paid — not just the statutory maximum.
